Anti-Money Laundering (AML)
EU member states have harmonised anti-money laundering legislation. However, accepted methods of remote identity verification differ between member states. What is an eIDAS qualified electronic signature?
A qualified electronic signature (QES) is the highest level of electronic signature under eIDAS regulation. Like an advanced signature, it ties a unique digital "pen" to a verified identity — but with stricter requirements. The key must be protected to the highest electronic security standards, and only a publicly authorised Qualified Trust Service Provider (QTSP) listed on the EU Trusted List is allowed to issue them. Once signed, a QES must be accepted by all EU member state courts and public authorities, and carries the same legal effect as a handwritten wet ink signature.
Why and when do I need to use an eIDAS advanced or qualified signature?
There are two main reasons companies need qualified electronic signatures in the EU. The first is risk — when a contract represents high commercial value, the signature needs to meet the highest integrity standards. An EU bank, for example, may require QES on mortgages and loans to prevent any challenge to the validity of the document based on the nature of the signature. The second is legal requirement — across the EU there are 10–15 major use cases per member state where qualified signing is mandated by law, including consumer and corporate lending, leasing, real estate transactions, employee agreements, and public tenders.
What are the benefits of a qualified electronic signature?
Qualified electronic signatures offer five key benefits over other signature types. First, they represent indisputable proof of identity and expression of will — recognised by EU legislation as legally equivalent to a wet ink signature. Second, they are standards-based and future-proof — the regulatory ecosystem covers terms and conditions, user rights, and GDPR compliance, making adoption predictable and cost-effective. Third, remote identification is fully regulated and not a black box — it must conform to national legislation, state of the art standards, and be certified and authorised by a supervisory body. Fourth, liability lies with the trust service provider, not the signing party — mandatory insurance policies are publicly published. Fifth, validation is straightforward — unlike advanced signatures, a qualified signature can be validated by anyone using freely accessible software without contacting the issuer.
The legal relationship with ZealiD
Working with a Qualified Trust Service Provider (QTSP) like ZealiD simplifies compliance in two ways. First, issuing certificates is a regulated business activity — you are not sub-contracting a service but working with a provider whose information security policy is set by law, conformity assessed, and authorised by a supervisory body. Unless you are a QTSP yourself, you do not have the legal right to issue certificates or perform identification. Second, all material information is publicly available in ZealiD's repository — regulation requires practice statements covering certificate lifecycle, liabilities, insurance policies, and terms and conditions to be published. This gives your compliance department full transparency and saves time by trusting a supervisory authority and leading security assessment bodies rather than conducting their own vendor due diligence.
